Relevant Agreement

A relevant agreement is:

  1. a contract of employment or any other agreement which is legally enforceable between the worker and the employer
  2. a workforce agreement
  3. a collective agreement which forms part of the worker's agreement with the employer [Working Time Regulations 1998 (WTR 1998), Regulation 2(1)]

Any provision in an agreement (whether a contract of employment or not) is void if it tries to exclude or limit the operation of any provision of the Regulations except where WTR 1998 makes provisions for an agreement to have that effect. Any provision in an agreement (whether a contract of employment or not) is void if it tries to preclude a person from bringing proceedings under WTR 1998 before an employment tribunal.
