  • There is no qualifying period for making a discrimination claim. This means that you don’t need two-year’s service to make a claim.
  • Time limits for making your claim are provided in section 123 Equality Act 2010. The time limit to make the claim is 3 months from the specific allegation you are claiming for. As an example, in a claim for harassment where you have resigned because of the harassment, the time limit rans from the harassment you are complaining about, not from the date of resignation.
  • In a discrimination claim, you have to calculate time limits for each incident of harassment.
  • If your claim relates to discrimination during armed forces service, your time limit is 6 months from the specific allegation you are claiming for.
  • Unlimited compensation means that there is no cap on the amount of compensation you can claim, unlike for unfair dismissal where there is a maximum. It does not mean that you can claim any amount that you want.
